Ownership of Outputs
As between you and Amiara, you own all rights to the unique Outputs you generate. However, the AI may produce the same or similar Outputs for other users. Amiara and its licensors retain all ownership rights in the underlying AI models and technology.
2. Your Amiara Account
You may need to create an account to access certain features. You are responsible for safeguarding your account information and for all activities that occur under your account. Please notify us immediately of any unauthorized use.
3. Fees and Payment
Some of our services may require payment. You agree to pay all applicable fees for the services you purchase. All fees are non-refundable except as required by law.
4. Prohibited Uses
In addition to other restrictions in these Terms, you agree not to use the AI Features:
• To develop competing AI models or services.
• To mislead anyone into believing that an Output was solely human-generated.
• For any illegal, harmful, or high-risk activities.
• To generate content that infringes on any third-party rights.
• To submit any sensitive personal data or confidential information without proper authorization.
5. Third-Party Services
Our AI Features may be powered by third-party providers. By using our services, you acknowledge that your Inputs may be processed by these providers. Your use of any third-party services is subject to their terms and conditions.
6. Disclaimer of Warranties
THE AMIARA.AI SITE AND ALL AI FEATURES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY OUTPUTS.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, AMIARA.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OUR SERVICES.
8. Dispute Resolution
All disputes arising out of or in connection with this agreement shall be resolved by binding arbitration on an individual basis. You waive your right to a jury trial and to participate in a class action lawsuit.
